Please read these terms carefully before booking

1. Introduction

These Terms and Conditions (‘Terms’) govern your use of the services provided by Way Out West Mountain Adventures (‘we’, ‘us’, ‘our’). By making a booking or participating in any of our activities, you agree to be bound by these Terms.

2. Bookings and Payment

2.1 Making a Booking

A booking is confirmed once we have received your completed booking form (or online registration) and the required deposit or full payment. We will send you a confirmation email upon receipt.

2.2 Pricing

All prices are as stated on our website or in our communications at the time of booking. Prices are inclusive of VAT where applicable. We reserve the right to amend prices for future bookings.

2.3 Payment

Payment may be made by credit/debit card, bank transfer, or other methods as agreed. For events requiring a deposit, the balance is due no later than 14 days before the event date unless otherwise stated.

3. Cancellations and Refunds

3.1 Cancellation by You

  • More than 28 days before the event: Full refund, less any non-refundable deposit
  • 14–28 days before the event: 50% refund of the total fee paid
  • Less than 14 days before the event: No refund

Cancellations must be made in writing to ros@wayoutwest.uk. The date of cancellation is the date we receive your written notice.

3.2 Cancellation by Us

We reserve the right to cancel or reschedule any event due to:

  • Severe or dangerous weather conditions
  • Insufficient participant numbers
  • Circumstances beyond our control (force majeure)
  • Safety concerns

In such cases, you will be offered a full refund or the option to transfer to an alternative date. We are not liable for any travel, accommodation, or other costs you may incur as a result of a cancellation.

4. Health, Fitness and Medical Information

Participation in our activities requires a reasonable level of physical fitness appropriate to the activity booked. It is your responsibility to ensure you are fit and well enough to participate.

You must inform us before booking or attending of any:

  • Medical conditions, disabilities, or injuries that may affect your participation or safety
  • Medications you are taking that could affect your performance or require emergency assistance
  • Pregnancy

We reserve the right to exclude any participant from an activity if we reasonably believe they are unfit to participate safely, without liability for any resulting costs.

5. Safety and Conduct

5.1 Instructor Authority

Our guides and instructors have overall responsibility for the safety of the group. Their decisions on safety matters are final. This includes the right to alter, shorten, or cancel any route or activity on the day in the interests of safety.

5.2 Participant Responsibilities

As a participant, you agree to:

  • Follow all reasonable instructions from our guides
  • Wear and use appropriate clothing and equipment as specified in pre-event information
  • Inform the guide immediately of any health or safety concern during the activity
  • Behave in a manner that does not endanger yourself, other participants, or third parties
  • Respect the natural environment, following Leave No Trace principles

We reserve the right to remove from an activity any participant whose conduct is deemed unsafe, disruptive, or unacceptable, without refund.

6. Equipment and Kit

Details of required clothing and equipment will be provided in advance of each activity. You are responsible for ensuring you have the appropriate kit. We may provide or loan certain equipment, which must be used with reasonable care and returned in good condition.

We are not liable for loss or damage to your personal equipment during our activities, unless caused by our negligence.

7. Photography and Social Media

We may take photographs or video footage during our activities for use in marketing materials, our website, and social media. By participating, you consent to this unless you notify us in writing before the event.

We will not tag or identify individuals without their express permission.

8. Liability and Indemnity

8.1 Our Liability

We take all reasonable steps to ensure the safety of our participants. However, outdoor activities in mountain and fell environments carry inherent risks, including risk of injury or death, which cannot be entirely eliminated.

Our liability to you is limited to the direct loss caused by our negligence or breach of contract. We do not exclude liability for death or personal injury caused by our negligence, or for any other liability that cannot be excluded by law.

We are not liable for:

  • Loss, theft, or damage to personal belongings
  • Costs arising from trip cancellation (including travel and accommodation)
  • Third-party actions or events beyond our reasonable control

8.2 Your Responsibility

You acknowledge that you voluntarily participate in outdoor activities which carry inherent risks. You agree that, to the fullest extent permitted by law, you assume responsibility for your own safety and wellbeing.

9. Insurance

We strongly recommend that all participants take out appropriate personal insurance covering:

  • Personal accident and medical expenses
  • Cancellation and curtailment
  • Loss of or damage to personal equipment

We hold appropriate public liability insurance. Details are available on request.

10. Women-Only Walks

Some of our walks and events are designated as women-only activities. Participation is open to women (including trans women) and non-binary individuals who feel comfortable in a women-centred space. These events are held in the spirit of inclusivity, safety, and community.

11. Complaints

If you are unhappy with any aspect of our service, please let us know as soon as possible so we can address your concern. Complaints should be directed to ros@wayoutwest.uk. We aim to respond within 5 working days.

12. Data Protection

We process your personal data in accordance with our Privacy Policy, available on our website at wayoutwest.uk. By making a booking, you acknowledge that we will use your data as described in that policy.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to These Terms

We may update these Terms from time to time. The current version will always be available at wayoutwest.uk. Continued use of our services after any changes constitutes acceptance of the revised Terms.
